According to an arrest report from the Miami-Dade Sheriffā€™s Office, the victim told detectives that she and the suspect, Martin Toledo-Cruz, who is a Mexican citizen currently living in Miami, are acquaintances who have a mutual friend.

The victim told detectives that she accepted a ride from Toledo-Cruz on Thursday night, and he began to fondle her breast over her clothing while they were in his car.

According to the arrest report, the victim asked Toledo-Cruz to stop, but he refused.

He then allegedly drove to an ā€œunknown construction site,ā€ parked the car and got on top of the victim before ripping off her leggings and raping her, the report stated.

According to the report, the victim repeatedly asked Toledo-Cruz to stop, but he refused.

The victim told detectives that after she was raped, Toledo-Cruz drove her to a local restaurant and purchased food for her before dropping her off close to her home.

Deputies said Toledo-Cruz was located Saturday night and provided some kind of admission, but his exact statement was redacted from the publicly released report.

Toledo-Cruz faces a charge of sexual battery.

While he was granted a $20,000 bond in the case, as of Monday, he remained held at the Turner Guilford Knight Correctional Center on an immigration hold.
