Miami-Dade med spa owner accused of illegally selling Ozempic equivalent, other weight loss meds

MIAMI-DADE COUNTY, Fla. – An undercover sting by Miami-Dade deputies led to the arrest of a medical spa owner who they said was doling out prescription weight loss medications — including one containing the active ingredient in Ozempic — even though she’s not a doctor.

Yanelys Fundora Acebo, 44, was taken into custody on Tuesday at her “X Lash by Yane” business at 9638 SW 72nd St. in the unincorporated Sunset area.

An arrest report from the Miami-Dade Sheriff’s Office states that detectives had received complaints that Fundora Acebo had been “selling and distributing lollipops containing phentermine,” a controlled substance used for weight loss, along with semaglutide — the same ingredient in diabetes drug Ozempic and weight loss drug Wegovy — and tirzepatide, which is used in diabetes drug Mounjaro and weight loss drug Zepbound.

Authorities said the X Lash by Yane Instagram page “boasted” of selling the drugs, with the ability to ship them anywhere in the U.S. and Puerto Rico, and even featured “several videos” of Fundora Acebo “injecting herself” with the prescription medications.

The page, which was still online as of Wednesday afternoon, listed one month of semaglutide treatment running for $230. It also shows a certificate from the Doral City Council congratulating the “beauty & wellness entrepreneur.”

It also features a video of her appearing on a local Spanish-language television station.

The report states that undercover investigators first went to X Lash by Yane on Sept. 27 and bought three phentermine lollipops over-the-counter.

Then, last Wednesday, an undercover detective went back to buy 10 more lollipops, deputies said.

According to the report, Fundora Acebo told the detective “she should play the lottery because she asked for (10) lollipops and that was what she had left.”

But Fundora Acebo’s own luck was running out, deputies said. She ended up in handcuffs less than a week later after deputies executed a search warrant at the business Tuesday.

An alleged admission was redacted from the MDSO arrest report.

Fundora Acebo is facing charges of practicing medicine without a license, dispensing drugs without a license and possession of a controlled substance.

In an interview Wednesday, Fundora Acebo insisted she is licensed, though according to the Florida Department of Health, she is a licensed massage therapist and not licensed to prescribe drugs.

She claimed everything was a misunderstanding.

“Everything was incorrect, of course,” she told Local 10 News in Spanish.

She had bonded out of jail Wednesday before her scheduled first appearance in court.
